7. Licensing Rules and Terms of Use
All voice recordings, registry records, supporting documents, and related deliverables are provided subject to these Terms of Use and any separate written agreement approved by Americas Voiceovers.
- Licenses are limited to the scope, territory, term, platform, and usage category expressly granted in writing.
- No customer receives ownership of our underlying intellectual property, production systems, registry systems, or platform materials unless a separate written transfer agreement is executed.
- Any use outside the approved license scope requires advance written permission and may require additional fees.
- Registry-related records, certificates, and documentation are administrative and evidentiary tools and do not replace independent legal advice, court orders, or government registration systems.
8. Prohibited AI Use and Unauthorized Cloning
These Terms of Use strictly prohibit unauthorized synthetic, cloned, biometric, or machine-generated use of any voice content obtained through our services or platform.
- You may not use any recording, sample, session output, or delivered file to train, fine-tune, prompt, simulate, replicate, or clone a voice model unless a separate written license expressly authorizes that use.
- You may not create, commission, distribute, sell, or deploy unauthorized voice clones, replicas, derivatives, or synthetic performances based on a voice associated with our services.
- You may not remove attribution, provenance data, metadata, watermarking, or other identifying information where provided.
- Any suspected AI misuse, impersonation, unauthorized cloning, or deceptive synthetic deployment may result in immediate suspension, termination, refusal of service, legal escalation, and takedown enforcement.
9. Copyright, DMCA, and Contract Requirements
Every voice job should be governed by clear written terms, and all parties are expected to respect copyright law, trademark rights, publicity rights, and platform enforcement procedures.
- Each voice project should include a written contract defining usage rights, revision limits, payment terms, delivery terms, approval standards, and prohibited uses.
- Customers are responsible for securing all rights needed for scripts, music, trademarks, claims, and third-party materials supplied to us.
- Copyright notices should be maintained where appropriate, and customers should preserve records showing authorship, creation dates, licenses, and approved usage scope.
- If you believe content infringes your rights, you should submit a proper DMCA notice or equivalent legal complaint through the appropriate enforcement channel.
- Rights holders should consider registering and maintaining a designated DMCA enforcement channel or agent where applicable so notices can be received and processed efficiently.
- We reserve the right to remove, disable, refuse, or preserve materials in response to infringement claims, legal notices, repeat violations, or platform abuse investigations.
10. Monitoring and Enforcement Guidance
Because unauthorized voice cloning and misuse can spread quickly online, customers and rights holders should actively monitor for misuse and enforce their rights without delay.
- Regularly monitor websites, marketplaces, social platforms, video platforms, podcast channels, ad libraries, and AI content tools for unauthorized voice use or clones.
- Preserve evidence immediately, including URLs, screenshots, timestamps, audio files, transaction records, and communications related to suspected misuse.
- Send takedown notices, cease-and-desist demands, platform complaints, and contract enforcement notices promptly when unauthorized use is discovered.
- Use layered protection strategies, including contracts, copyright registration, trademark protection, publicity rights, evidence archives, and technical monitoring.
- Nothing in these Terms of Use prevents us from cooperating with lawful investigations, preserving records, or taking protective action to address fraud, impersonation, infringement, or misuse of voice assets.
